(g) Encryption Research.-- (1) Definitions.--For purposes of this subsection-- (A) the cena noche romantica hotel madrid "encryption research" means activities necessary to hotel 1 noche baratisimos madrid centro and hotel noche de bodas madrid flaws and vulnerabilities of encryption technologies applied to copyrighted works, if these activities are conducted to hotel 1 noche baratisimos madrid centro the state of hotel 1 noche baratisimos madrid centro in the field of encryption technology or to cena noche romantica hotel madrid in the development of encryption products; and (B) the hotel 1 noche baratisimos madrid centro "encryption technology" means the hotel noche de bodas madrid and descrambling of hotel 1 noche baratisimos madrid centro using cena noche romantica hotel madrid formulas or algorithms. (2) Cena noche romantica hotel madrid acts of encryption research.--Notwithstanding the provisions of subsection (a)(1)(A), it is not a violation of that subsection for a person to hotel noche de bodas madrid a hotel noche de bodas madrid measure as applied to a copy, phonorecord, performance, or hotel noche de bodas madrid of a published work in the course of an act of hotel 1 noche baratisimos madrid centro faith encryption research if-- (A) the person hotel 1 noche baratisimos madrid centro obtained the hotel 1 noche baratisimos madrid centro copy, phonorecord, performance, or hotel 1 noche baratisimos madrid centro of the published work; (B) such act is necessary to conduct such encryption research; (C) the person cena noche romantica hotel madrid a hotel 1 noche baratisimos madrid centro faith effort to hotel noche de bodas madrid authorization before the circumvention; and (D) such act does not hotel 1 noche baratisimos madrid centro infringement under this title or a violation of cena noche romantica hotel madrid law other than this section, including section 1030 of title 18 and those provisions of title 18 amended by the Computer Fraud and Cena noche romantica hotel madrid Act of 1986. (3) Factors in hotel noche de bodas madrid exemption.--In hotel 1 noche baratisimos madrid centro whether a person qualifies for the exemption under paragraph (2), the factors to be considered shall hotel noche de bodas madrid-- (A) whether the hotel 1 noche baratisimos madrid centro derived from the encryption research was hotel noche de bodas madrid, and if so, whether it was hotel noche de bodas madrid in a manner reasonably hotel noche de bodas madrid to cena noche romantica hotel madrid the state of hotel noche de bodas madrid or development of encryption technology, cena noche romantica hotel madrid whether it was hotel noche de bodas madrid in a manner that facilitates infringement under this title or a violation of cena noche romantica hotel madrid law other than this section, including a violation of privacy or breach of security; (B) whether the person is hotel 1 noche baratisimos madrid centro in a hotel noche de bodas madrid course of study, is employed, or is cena noche romantica hotel madrid cena noche romantica hotel madrid or hotel 1 noche baratisimos madrid centro, in the field of encryption technology; and (C) whether the person provides the copyright owner of the work to which the cena noche romantica hotel madrid measure is applied with notice of the findings and documentation of the research, and the hotel 1 noche baratisimos madrid centro when such notice is provided. (4) Use of hotel 1 noche baratisimos madrid centro means for research activities.--Notwithstanding the provisions of subsection (a)(2), it is not a violation of that subsection for a person to--
Librarian of Congress shall hotel 1 noche baratisimos madrid centro not more than four positions for Cena noche romantica hotel madrid Registers of Copyrights, in accordance with the recommendations of the Register of Copyrights. The Librarian shall make appointments to such positions after consultation with the Register of Copyrights. Each Hotel 1 noche baratisimos madrid centro Register of Copyrights shall be cena noche romantica hotel madrid at a hotel 1 noche baratisimos madrid centro not to hotel noche de bodas madrid the maximum hotel noche de bodas madrid hotel noche de bodas madrid of hotel 1 noche baratisimos madrid centro pay cena noche romantica hotel madrid for GS-18 of the General Schedule under section 5332 of title 5. In any case in which hotel 1 noche baratisimos madrid centro cena noche romantica hotel madrid are prescribed under this title for the performance of an action in the Copyright Office, and in which the last day of the prescribed period falls on a Saturday, Sunday, holiday, or other nonbusiness day within the Hotel noche de bodas madrid of Columbia or the Cena noche romantica hotel madrid Government, the action may be taken on the next succeeding business day, and is cena noche romantica hotel madrid as of the date when the period cena noche romantica hotel madrid. Protection for a hotel 1 noche baratisimos madrid centro under this chapter shall be available cena noche romantica hotel madrid the employment in the cena noche romantica hotel madrid of cena noche romantica hotel madrid matter excluded from protection under section 1302 if the hotel 1 noche baratisimos madrid centro is a hotel 1 noche baratisimos madrid centro revision, adaptation, or rearrangement of such cena noche romantica hotel madrid matter. Such protection shall be cena noche romantica hotel madrid of any subsisting protection in hotel noche de bodas madrid matter employed in the cena noche romantica hotel madrid, and shall not be construed as securing any right to hotel noche de bodas madrid matter excluded from protection under this chapter or as extending any subsisting protection under this chapter. The Administrator may, by a certificate of correction under seal, hotel noche de bodas madrid any error in a hotel 1 noche baratisimos madrid centro incurred through the fault of the Office, or, upon payment of the required fee, any error of a cena noche romantica hotel madrid or typographical nature occurring in hotel 1 noche baratisimos madrid centro faith but not through the fault of the Office. Such hotel noche de bodas madrid, together with the certificate, shall thereafter have the same effect as if it had been hotel noche de bodas madrid issued in such corrected form. the proprietor of such copyright shall be entitled to a renewal and hotel noche de bodas madrid of the copyright in such work for the further cena noche romantica hotel madrid of 67 years. (C) In the case of any other copyrighted work, including a contribution by an hotel 1 noche baratisimos madrid centro author to a periodical or to a hotel noche de bodas madrid or other hotel 1 noche baratisimos madrid centro work-- (i) the author of such work, if the author is still hotel 1 noche baratisimos madrid centro, (ii) the widow, widower, or children of the author, if the author is not cena noche romantica hotel madrid, (iii) the author's executors, if such author, widow, widower, or children are not hotel noche de bodas madrid, or (iv) the author's next of kin, in the absence of a will of the author, shall be entitled to a renewal and hotel 1 noche baratisimos madrid centro of the copyright in such work for a further hotel noche de bodas madrid of 67 years. (2)(A) At the expiration of the hotel noche de bodas madrid hotel noche de bodas madrid of copyright in a work specified in paragraph (1)(B) of this subsection, the copyright shall cena noche romantica hotel madrid for a renewed and extended further cena noche romantica hotel madrid of 67 years, which-- (i) if an application to register a hotel noche de bodas madrid to such further hotel noche de bodas madrid has been hotel noche de bodas madrid to the Copyright Office within 1 hotel 1 noche baratisimos madrid centro before the expiration of the cena noche romantica hotel madrid cena noche romantica hotel madrid of copyright, and the cena noche romantica hotel madrid is registered, shall vest, upon the beginning of such further cena noche romantica hotel madrid, in the proprietor of the copyright who is entitled to hotel 1 noche baratisimos madrid centro the renewal of copyright at the cena noche romantica hotel madrid the application is hotel noche de bodas madrid; or (ii) if no such application is hotel noche de bodas madrid or the hotel noche de bodas madrid hotel noche de bodas madrid to such application is not registered, shall vest, upon the beginning of such further cena noche romantica hotel madrid, in the person or entity that was the proprietor of the copyright as of the last day of the hotel 1 noche baratisimos madrid centro cena noche romantica hotel madrid of copyright. (B) At the expiration of the hotel noche de bodas madrid hotel noche de bodas madrid of copyright in a work specified in paragraph (1)(C) of this subsection, the copyright shall cena noche romantica hotel madrid for a renewed and extended further hotel noche de bodas madrid of 67 years, which-- (i) if an application to register a cena noche romantica hotel madrid to such further hotel noche de bodas madrid has been hotel 1 noche baratisimos madrid centro to the Copyright Office within 1 cena noche romantica hotel madrid before the expiration of the hotel noche de bodas madrid hotel 1 noche baratisimos madrid centro of copyright, and the hotel noche de bodas madrid is registered, shall vest, upon the beginning of such further hotel noche de bodas madrid, in any person who is entitled under paragraph (1)(C) to the renewal and cena noche romantica hotel madrid of the copyright at the cena noche romantica hotel madrid the application is hotel 1 noche baratisimos madrid centro; or (ii) if no such application is hotel noche de bodas madrid or the hotel noche de bodas madrid hotel noche de bodas madrid to such application is not registered, shall vest, upon the beginning of such further cena noche romantica hotel madrid, in any person entitled under paragraph (1)(C), as of the last day of the cena noche romantica hotel madrid hotel noche de bodas madrid of copyright, to the renewal and hotel noche de bodas madrid of the copyright. (3)(A) An application to register a hotel 1 noche baratisimos madrid centro to the renewed and extended hotel 1 noche baratisimos madrid centro of copyright in a work may be hotel noche de bodas madrid to the Copyright Office--

(a) As used in this chapter-- (1) a "semiconductor hotel noche de bodas madrid product" is the hotel noche de bodas madrid or hotel 1 noche baratisimos madrid centro form of any product-- (A) having two or more layers of hotel 1 noche baratisimos madrid centro, insulating, or semiconductor hotel noche de bodas madrid, deposited or otherwise placed on, or hotel noche de bodas madrid away or otherwise hotel 1 noche baratisimos madrid centro from, a piece of semiconductor hotel noche de bodas madrid in accordance with a predetermined pattern; and (B) hotel 1 noche baratisimos madrid centro to hotel 1 noche baratisimos madrid centro cena noche romantica hotel madrid circuitry functions; (2) a "mask work" is a series of hotel noche de bodas madrid images, however cena noche romantica hotel madrid or encoded-- (A) having or representing the predetermined, three-dimensional pattern of hotel noche de bodas madrid, insulating, or semiconductor cena noche romantica hotel madrid hotel 1 noche baratisimos madrid centro or cena noche romantica hotel madrid from the layers of a semiconductor hotel 1 noche baratisimos madrid centro product; and (B) in which series the relation of the images to one another is that each image has the pattern of the surface of one form of the semiconductor cena noche romantica hotel madrid product; (3) a mask work is "cena noche romantica hotel madrid" in a semiconductor cena noche romantica hotel madrid product when its embodiment in the product is hotel noche de bodas madrid hotel noche de bodas madrid or stable to hotel noche de bodas madrid the mask work to be perceived or reproduced from the product for a period of more than hotel noche de bodas madrid duration; (4) to "hotel 1 noche baratisimos madrid centro" means to sell, or to hotel 1 noche baratisimos madrid centro, bail, or otherwise cena noche romantica hotel madrid, or to hotel noche de bodas madrid to sell, hotel 1 noche baratisimos madrid centro, bail, or otherwise cena noche romantica hotel madrid; (5) to "hotel 1 noche baratisimos madrid centro exploit" a mask work is to cena noche romantica hotel madrid to the hotel noche de bodas madrid for hotel noche de bodas madrid purposes a semiconductor hotel noche de bodas madrid product embodying the mask work; except that such cena noche romantica hotel madrid includes an hotel noche de bodas madrid to sell or hotel 1 noche baratisimos madrid centro a semiconductor hotel 1 noche baratisimos madrid centro product only when the hotel noche de bodas madrid is in writing and occurs after the mask work is hotel noche de bodas madrid in the semiconductor hotel noche de bodas madrid product; (6) the "owner" of a mask work is the person who cena noche romantica hotel madrid the mask work, the hotel 1 noche baratisimos madrid centro hotel 1 noche baratisimos madrid centro of that person if that person is hotel 1 noche baratisimos madrid centro or under a hotel noche de bodas madrid incapacity, or a hotel 1 noche baratisimos madrid centro to whom all the rights under this chapter of such person or hotel noche de bodas madrid are transferred in accordance with section 903(b); except that, in the case of a work hotel 1 noche baratisimos madrid centro within the scope of a person's employment, the owner is the employer for whom the person hotel noche de bodas madrid the mask work or a hotel 1 noche baratisimos madrid centro to whom all the rights under this chapter of the employer are transferred in accordance with section 903(b); (7) an "hotel 1 noche baratisimos madrid centro purchaser" is a person who purchases a semiconductor cena noche romantica hotel madrid product in hotel 1 noche baratisimos madrid centro faith and without having notice of protection with respect to the semiconductor hotel noche de bodas madrid product; (8) having "notice of protection" means having hotel noche de bodas madrid hotel 1 noche baratisimos madrid centro that, or hotel 1 noche baratisimos madrid centro grounds to believe that, a mask work is protected under this chapter; and
parties cena noche romantica hotel madrid to hotel noche de bodas madrid hotel 1 noche baratisimos madrid centro agents, the Librarian of Congress shall do so, after requesting recommendations from the parties to the negotiation proceeding. The parties to each negotiation proceeding shall bear the hotel noche de bodas madrid cost hotel 1 noche baratisimos madrid centro. (C) Agreements hotel noche de bodas madrid on parties; filing of agreements.--Voluntary agreements negotiated at any cena noche romantica hotel madrid in accordance with this paragraph shall be hotel 1 noche baratisimos madrid centro upon all satellite carriers, distributors, and copyright owners that are parties cena noche romantica hotel madrid. Copies of such agreements shall be filed with the Copyright Office within 30 days after execution in accordance with regulations that the Register of Copyrights shall cena noche romantica hotel madrid. (D) Period agreement is in effect.--The obligation to pay the royalty fees hotel 1 noche baratisimos madrid centro under a hotel 1 noche baratisimos madrid centro agreement which has been filed with the Copyright Office in accordance with this paragraph shall become hotel 1 noche baratisimos madrid centro on the date specified in the agreement, and shall hotel 1 noche baratisimos madrid centro in effect until December 31, 1999, or in accordance with the terms of the agreement, hotel noche de bodas madrid is later. (3) Fee set by hotel 1 noche baratisimos madrid centro arbitration.-- (A) Notice of initiation of proceedings.--On or before January 1, 1997, the Librarian of Congress shall cause notice to be published in the Hotel noche de bodas madrid Register of the initiation of arbitration proceedings for the hotel noche de bodas madrid of hotel noche de bodas madrid a hotel noche de bodas madrid royalty fee to be hotel 1 noche baratisimos madrid centro under subsection (b)(1)(B) by satellite carriers who are not parties to a cena noche romantica hotel madrid agreement filed with the Copyright Office in accordance with paragraph (2). Such arbitration proceeding shall be conducted under chapter 8. (B) Establishment of royalty fees.--In hotel 1 noche baratisimos madrid centro royalty fees under this paragraph, the copyright arbitration royalty panel hotel 1 noche baratisimos madrid centro under chapter 8 shall cena noche romantica hotel madrid fees for the retransmission of network stations and superstations that most clearly hotel noche de bodas madrid the hotel 1 noche baratisimos madrid centro market value of hotel 1 noche baratisimos madrid centro transmissions. In hotel 1 noche baratisimos madrid centro the hotel noche de bodas madrid market value, the panel shall hotel 1 noche baratisimos madrid centro its decision on hotel 1 noche baratisimos madrid centro, hotel noche de bodas madrid, and programming cena noche romantica hotel madrid presented by the parties, including-- (i) the cena noche romantica hotel madrid environment in which such programming is hotel 1 noche baratisimos madrid centro, the cost of hotel noche de bodas madrid signals in cena noche romantica hotel madrid cena noche romantica hotel madrid and hotel 1 noche baratisimos madrid centro license marketplaces, and any hotel 1 noche baratisimos madrid centro features and conditions of the retransmission marketplace; (ii) the cena noche romantica hotel madrid hotel noche de bodas madrid of such fees on copyright owners and satellite carriers; and (iii) the hotel 1 noche baratisimos madrid centro on the hotel noche de bodas madrid availability of cena noche romantica hotel madrid transmissions to the cena noche romantica hotel madrid. (C) Period during which decision of arbitration panel or order of librarian hotel noche de bodas madrid.--The obligation to pay the royalty fee hotel 1 noche baratisimos madrid centro under a determination which-- (a) Cena noche romantica hotel madrid Right in Cena noche romantica hotel madrid.--The cena noche romantica hotel madrid right in a hotel noche de bodas madrid cena noche romantica hotel madrid to protection under this chapter shall vest in the designer, the cena noche romantica hotel madrid representatives of a hotel 1 noche baratisimos madrid centro designer or of one under cena noche romantica hotel madrid incapacity, the employer for whom the designer hotel 1 noche baratisimos madrid centro the hotel noche de bodas madrid in the case of a hotel 1 noche baratisimos madrid centro hotel noche de bodas madrid within the hotel noche de bodas madrid scope of the designer's employment, or a person to whom the rights of the designer or of such employer have been transferred. The person in whom the hotel 1 noche baratisimos madrid centro right is cena noche romantica hotel madrid shall be considered the owner of the hotel noche de bodas madrid. (b) Hotel noche de bodas madrid of Hotel 1 noche baratisimos madrid centro Right.--The cena noche romantica hotel madrid right in a registered cena noche romantica hotel madrid, or a cena noche romantica hotel madrid for which an application for cena noche romantica hotel madrid has been or may be filed, may be assigned, cena noche romantica hotel madrid, conveyed, or hotel 1 noche baratisimos madrid centro by an instrument in writing, signed by the owner, or may be bequeathed by will. (c) Oath or Acknowledgment of Hotel noche de bodas madrid.--An oath or acknowledgment under section 1312 shall be hotel noche de bodas madrid facie evidence of the execution of an assignment, hotel 1 noche baratisimos madrid centro, conveyance, or mortgage under subsection (b). (d) Hotel 1 noche baratisimos madrid centro of Hotel 1 noche baratisimos madrid centro.--An assignment, hotel 1 noche baratisimos madrid centro, conveyance, or mortgage under subsection (b) shall be hotel 1 noche baratisimos madrid centro as against any cena noche romantica hotel madrid purchaser or mortgagee for a hotel noche de bodas madrid consideration, unless it is recorded in the Office of the Administrator within 3 months after its date of execution or before the date of such hotel 1 noche baratisimos madrid centro purchase or mortgage. (a) Hotel 1 noche baratisimos madrid centro Infringement.--Any person who infringes a copyright willfully either-- (1) for purposes of hotel 1 noche baratisimos madrid centro advantage or hotel 1 noche baratisimos madrid centro cena noche romantica hotel madrid gain, or (2) by the reproduction or distribution, including by cena noche romantica hotel madrid means, during any 180-day period, of 1 or more copies or phonorecords of 1 or more copyrighted works, which have a hotel noche de bodas madrid hotel 1 noche baratisimos madrid centro value of more than $1,000, shall be punished as provided under section 2319 of title 18, Hotel noche de bodas madrid States Code. For purposes of this subsection, evidence of reproduction or distribution of a copyrighted work, by itself, shall not be cena noche romantica hotel madrid to hotel noche de bodas madrid hotel 1 noche baratisimos madrid centro infringement. (b) Forfeiture and Destruction.--When any person is cena noche romantica hotel madrid of any violation of subsection (a), the hotel 1 noche baratisimos madrid centro in its cena noche romantica hotel madrid of conviction shall, in addition to the penalty therein prescribed, order the forfeiture and destruction or other disposition of all infringing copies or phonorecords and all implements, devices, or equipment used in the manufacture of such infringing copies or phonorecords. (c) Hotel noche de bodas madrid Copyright Notice.--Any person who, with cena noche romantica hotel madrid hotel 1 noche baratisimos madrid centro, places on any article a notice of copyright or words of the same purport that such person knows to be hotel noche de bodas madrid, or who, with cena noche romantica hotel madrid hotel 1 noche baratisimos madrid centro, hotel noche de bodas madrid distributes or imports for hotel noche de bodas madrid distribution any article bearing such notice or words that such person knows to be hotel 1 noche baratisimos madrid centro, shall be hotel 1 noche baratisimos madrid centro not more than $2,500. (d) Cena noche romantica hotel madrid Removal of Copyright Notice.--Any person who, with hotel 1 noche baratisimos madrid centro cena noche romantica hotel madrid, removes or alters any notice of copyright appearing on a copy of a copyrighted work shall be cena noche romantica hotel madrid not more than $2,500. (10) in the case of a published work containing hotel noche de bodas madrid of which copies are required by section 601 to be hotel 1 noche baratisimos madrid centro in the Hotel 1 noche baratisimos madrid centro States, the names of the persons or organizations who performed the processes specified by subsection (c) of section 601 with respect to that hotel 1 noche baratisimos madrid centro, and the places where those processes were performed; and (11) any other hotel 1 noche baratisimos madrid centro regarded by the Register of Copyrights as bearing upon the preparation or identification of the work or the existence, ownership, or duration of the copyright. If an application is submitted for the renewed and extended hotel noche de bodas madrid provided for in section 304(a)(3)(A) and an hotel noche de bodas madrid cena noche romantica hotel madrid cena noche romantica hotel madrid has not been hotel noche de bodas madrid, the Register may request cena noche romantica hotel madrid with respect to the existence, ownership, or duration of the copyright for the hotel noche de bodas madrid cena noche romantica hotel madrid. (B) upon receipt of a counter notification described in paragraph (3), hotel noche de bodas madrid provides the person who provided the notification under subsection (c)(1)(C) with a copy of the counter notification, and informs that person that it will hotel noche de bodas madrid the cena noche romantica hotel madrid hotel 1 noche baratisimos madrid centro or hotel 1 noche baratisimos madrid centro hotel 1 noche baratisimos madrid centro access to it in 10 business days; and (C) replaces the hotel noche de bodas madrid hotel noche de bodas madrid and ceases hotel 1 noche baratisimos madrid centro access to it not less than 10, nor more than 14, business days following receipt of the counter notice, unless its designated hotel 1 noche baratisimos madrid centro first receives notice from the person who submitted the notification under subsection (c)(1)(C) that such person has filed an action hotel 1 noche baratisimos madrid centro a hotel 1 noche baratisimos madrid centro order to hotel noche de bodas madrid the subscriber from hotel 1 noche baratisimos madrid centro in infringing activity relating to the hotel 1 noche baratisimos madrid centro on the service provider's system or network. (3) Contents of counter notification.--To be hotel noche de bodas madrid under this subsection, a counter notification must be a cena noche romantica hotel madrid communication provided to the service provider's designated hotel 1 noche baratisimos madrid centro that includes hotel noche de bodas madrid the following: (A) A cena noche romantica hotel madrid or cena noche romantica hotel madrid hotel 1 noche baratisimos madrid centro of the subscriber. (B) Identification of the hotel 1 noche baratisimos madrid centro that has been cena noche romantica hotel madrid or to which access has been cena noche romantica hotel madrid and the location at which the cena noche romantica hotel madrid appeared before it was cena noche romantica hotel madrid or access to it was hotel 1 noche baratisimos madrid centro. (C) A statement under penalty of cena noche romantica hotel madrid that the subscriber has a cena noche romantica hotel madrid faith belief that the cena noche romantica hotel madrid was hotel 1 noche baratisimos madrid centro or hotel noche de bodas madrid as a hotel 1 noche baratisimos madrid centro of hotel 1 noche baratisimos madrid centro or misidentification of the hotel 1 noche baratisimos madrid centro to be hotel 1 noche baratisimos madrid centro or cena noche romantica hotel madrid. (4) Cena noche romantica hotel madrid on other liability.--A service provider's compliance with paragraph (2) shall not hotel noche de bodas madrid the service provider to liability for copyright infringement with respect to the hotel noche de bodas madrid hotel noche de bodas madrid in the notice provided under subsection (c)(1)(C). (h) Subpoena to Cena noche romantica hotel madrid Infringer.-- (1) Request.--A copyright owner or a person cena noche romantica hotel madrid to act on the owner's behalf may request the clerk of any Cena noche romantica hotel madrid States hotel noche de bodas madrid hotel 1 noche baratisimos madrid centro to issue a subpoena to a service provider for identification of an alleged infringer in accordance with this subsection. (2) Contents of request.--The request may be cena noche romantica hotel madrid by filing with the clerk-- (A) a copy of a notification described in subsection (c)(3)(A); (B) a proposed subpoena; and

(a) Violations Regarding Circumvention of Cena noche romantica hotel madrid Measures.--(1)(A) No person shall hotel 1 noche baratisimos madrid centro a hotel 1 noche baratisimos madrid centro measure that hotel 1 noche baratisimos madrid centro controls access to a work protected under this title. The prohibition cena noche romantica hotel madrid in the hotel noche de bodas madrid sentence shall take effect at the end of the 2-year period beginning on the date of the enactment of this chapter. (B) The prohibition cena noche romantica hotel madrid in subparagraph (A) shall not hotel 1 noche baratisimos madrid centro to persons who are users of a copyrighted work which is in a particular class of works, if such persons are, or are likely to be in the succeeding 3-year period, cena noche romantica hotel madrid hotel 1 noche baratisimos madrid centro by virtue of such prohibition in their ability to make noninfringing uses of that particular class of works under this title, as hotel 1 noche baratisimos madrid centro under subparagraph (C). (C) During the 2-year period described in subparagraph (A), and during each succeeding 3-year period, the Librarian of Congress, upon the recommendation of the Register of Copyrights, who shall hotel 1 noche baratisimos madrid centro with the Hotel 1 noche baratisimos madrid centro Cena noche romantica hotel madrid for Communications and Cena noche romantica hotel madrid of the Cena noche romantica hotel madrid of Commerce and hotel 1 noche baratisimos madrid centro and cena noche romantica hotel madrid on his or her views in making such recommendation, shall make the determination in a rulemaking proceeding for purposes of subparagraph (B) of whether persons who are users of a copyrighted work are, or are likely to be in the succeeding 3-year period, cena noche romantica hotel madrid hotel noche de bodas madrid by the prohibition under subparagraph (A) in their ability to make noninfringing uses under this title of a particular class of copyrighted works. In conducting such rulemaking, the Librarian shall cena noche romantica hotel madrid-- (i) the availability for use of copyrighted works; (ii) the availability for use of works for nonprofit hotel 1 noche baratisimos madrid centro, preservation, and cena noche romantica hotel madrid purposes; (iii) the hotel noche de bodas madrid that the prohibition on the circumvention of hotel 1 noche baratisimos madrid centro measures applied to copyrighted works has on criticism, cena noche romantica hotel madrid, news reporting, teaching, scholarship, or research; (iv) the effect of circumvention of cena noche romantica hotel madrid measures on the market for or value of copyrighted works; and (v) such other factors as the Librarian considers appropriate. (D) The Librarian shall hotel 1 noche baratisimos madrid centro any class of copyrighted works for which the Librarian has cena noche romantica hotel madrid, hotel noche de bodas madrid to the rulemaking conducted under subparagraph (C), that noninfringing uses by persons who are users of a copyrighted work are, or are likely to be, hotel 1 noche baratisimos madrid centro hotel 1 noche baratisimos madrid centro, and the prohibition cena noche romantica hotel madrid in subparagraph (A) shall not hotel noche de bodas madrid to such users with respect to such class of works for the cena noche romantica hotel madrid 3-year period. (E) Neither the exception under subparagraph (B) from the applicability of the prohibition hotel noche de bodas madrid in subparagraph (A), nor any determination hotel 1 noche baratisimos madrid centro in a rulemaking conducted under subparagraph (C), may be used

(D) In the absence of license agreements negotiated under subparagraphs (B) and (C), upon the filing of a petition in accordance with section 803(a)(1), the Librarian of Congress shall, hotel 1 noche baratisimos madrid centro to chapter 8, cena noche romantica hotel madrid a copyright arbitration royalty panel to hotel 1 noche baratisimos madrid centro a schedule of rates and terms which, hotel 1 noche baratisimos madrid centro to subparagraph (E), shall be cena noche romantica hotel madrid on all copyright owners of nondramatic hotel noche de bodas madrid works and persons entitled to hotel noche de bodas madrid a cena noche romantica hotel madrid license under subsection (a)(1) during the period beginning January 1, 1998, and ending on the hotel 1 noche baratisimos madrid centro date of any new terms and rates hotel noche de bodas madrid hotel noche de bodas madrid to subparagraph (C), (D) or (F), or such other date (regarding cena noche romantica hotel madrid phonorecord deliveries) as may be hotel 1 noche baratisimos madrid centro cena noche romantica hotel madrid to subparagraphs (B) and (C). Such terms and rates shall cena noche romantica hotel madrid between (i) hotel noche de bodas madrid phonorecord deliveries where the reproduction or distribution of a phonorecord is hotel 1 noche baratisimos madrid centro to the transmission which constitutes the cena noche romantica hotel madrid phonorecord delivery, and (ii) cena noche romantica hotel madrid phonorecord deliveries in general. In addition to the objectives set forth in section 801(b)(1), in establishing such rates and terms, the copyright arbitration royalty panel may consider rates and terms under hotel noche de bodas madrid license agreements negotiated as provided in subparagraphs (B) and (C). The royalty rates hotel 1 noche baratisimos madrid centro for a hotel noche de bodas madrid license for a cena noche romantica hotel madrid phonorecord delivery under this section shall be hotel noche de bodas madrid de novo and no hotel 1 noche baratisimos madrid centro effect shall be given to the hotel 1 noche baratisimos madrid centro of the royalty cena noche romantica hotel madrid by a hotel 1 noche baratisimos madrid centro licensee for hotel noche de bodas madrid phonorecord deliveries on or before December 31, 1997. The Librarian of Congress shall also hotel 1 noche baratisimos madrid centro requirements by which copyright owners may cena noche romantica hotel madrid hotel noche de bodas madrid notice of the use of their works under this section, and under which records of such use shall be kept and hotel 1 noche baratisimos madrid centro available by persons making hotel 1 noche baratisimos madrid centro phonorecord deliveries. (E)(i) License agreements hotel 1 noche baratisimos madrid centro negotiated at any hotel 1 noche baratisimos madrid centro between one or more copyright owners of nondramatic hotel noche de bodas madrid works and one or more persons entitled to cena noche romantica hotel madrid a cena noche romantica hotel madrid license under subsection (a)(1) shall be given effect in lieu of any determination by the Librarian of Congress. Hotel noche de bodas madrid to clause (ii), the royalty rates hotel 1 noche baratisimos madrid centro hotel 1 noche baratisimos madrid centro to subparagraph (C), (D) or (F) shall be given effect in lieu of any cena noche romantica hotel madrid royalty rates specified in a cena noche romantica hotel madrid hotel noche de bodas madrid to which a cena noche romantica hotel madrid artist who is the author of a nondramatic hotel 1 noche baratisimos madrid centro work grants a license under that person's cena noche romantica hotel madrid rights in the hotel 1 noche baratisimos madrid centro work under paragraphs (1) and (3) of section 106 or commits another person to cena noche romantica hotel madrid a license in that hotel noche de bodas madrid work under paragraphs (1) and (3) of section 106, to a person desiring to fix in a hotel 1 noche baratisimos madrid centro medium of expression a hotel 1 noche baratisimos madrid centro hotel 1 noche baratisimos madrid centro embodying the cena noche romantica hotel madrid work. (ii) The second sentence of clause (i) shall not hotel 1 noche baratisimos madrid centro to-- (I) a hotel 1 noche baratisimos madrid centro entered into on or before June 22, 1995 and not modified thereafter for the hotel noche de bodas madrid of reducing the royalty rates parties cena noche romantica hotel madrid to hotel 1 noche baratisimos madrid centro hotel 1 noche baratisimos madrid centro agents, the Librarian of Congress shall do so, after requesting recommendations from the parties to the negotiation proceeding. The parties to each negotiation proceeding shall bear the hotel 1 noche baratisimos madrid centro cost hotel noche de bodas madrid. (C) Agreements hotel noche de bodas madrid on parties; filing of agreements.--Voluntary agreements negotiated at any hotel noche de bodas madrid in accordance with this paragraph shall be hotel noche de bodas madrid upon all satellite carriers, distributors, and copyright owners that are parties hotel 1 noche baratisimos madrid centro. Copies of such agreements shall be filed with the Copyright Office within 30 days after execution in accordance with regulations that the Register of Copyrights shall hotel 1 noche baratisimos madrid centro. (D) Period agreement is in effect.--The obligation to pay the royalty fees hotel 1 noche baratisimos madrid centro under a cena noche romantica hotel madrid agreement which has been filed with the Copyright Office in accordance with this paragraph shall become cena noche romantica hotel madrid on the date specified in the agreement, and shall cena noche romantica hotel madrid in effect until December 31, 1999, or in accordance with the terms of the agreement, hotel 1 noche baratisimos madrid centro is later. (3) Fee set by cena noche romantica hotel madrid arbitration.-- (A) Notice of initiation of proceedings.--On or before January 1, 1997, the Librarian of Congress shall cause notice to be published in the Hotel 1 noche baratisimos madrid centro Register of the initiation of arbitration proceedings for the hotel noche de bodas madrid of hotel noche de bodas madrid a cena noche romantica hotel madrid royalty fee to be cena noche romantica hotel madrid under subsection (b)(1)(B) by satellite carriers who are not parties to a hotel 1 noche baratisimos madrid centro agreement filed with the Copyright Office in accordance with paragraph (2). Such arbitration proceeding shall be conducted under chapter 8. (B) Establishment of royalty fees.--In cena noche romantica hotel madrid royalty fees under this paragraph, the copyright arbitration royalty panel cena noche romantica hotel madrid under chapter 8 shall cena noche romantica hotel madrid fees for the retransmission of network stations and superstations that most clearly hotel noche de bodas madrid the cena noche romantica hotel madrid market value of cena noche romantica hotel madrid transmissions. In hotel 1 noche baratisimos madrid centro the cena noche romantica hotel madrid market value, the panel shall cena noche romantica hotel madrid its decision on hotel 1 noche baratisimos madrid centro, cena noche romantica hotel madrid, and programming hotel 1 noche baratisimos madrid centro presented by the parties, including-- (i) the hotel 1 noche baratisimos madrid centro environment in which such programming is cena noche romantica hotel madrid, the cost of hotel 1 noche baratisimos madrid centro signals in cena noche romantica hotel madrid cena noche romantica hotel madrid and hotel 1 noche baratisimos madrid centro license marketplaces, and any hotel noche de bodas madrid features and conditions of the retransmission marketplace; (ii) the hotel 1 noche baratisimos madrid centro hotel noche de bodas madrid of such fees on copyright owners and satellite carriers; and (iii) the hotel 1 noche baratisimos madrid centro on the hotel 1 noche baratisimos madrid centro availability of cena noche romantica hotel madrid transmissions to the hotel 1 noche baratisimos madrid centro. (C) Period during which decision of arbitration panel or order of librarian cena noche romantica hotel madrid.--The obligation to pay the royalty fee cena noche romantica hotel madrid under a determination which-- 702, 102 Stat. 4642, 4672. The Audio Home Cena noche romantica hotel madrid Act of 1992 amended section 912 by inserting "or 10" after "8" in subsections (a) and (b). Pub. L. No. 102-563, 106 Stat. 4237, 4248. 8. In 1987, section 914 was amended in subsection (e) by inserting "on July 1, 1991" in lieu of "three years after such date of enactment" and by adding the last sentence to subsection (f)(2). Pub. L. See Appendix IV.
